Terms and Conditions
Effective Date: January 5, 2026
The following terms and conditions apply to any persons who will be receiving lodging and hospitality services provided by The Cara Hotel (Managed by The Cara Management Sdn Bhd). By making a reservation, all guests agree to comply with these conditions.
1.1 Booking Methods
- Reservations can be made via our official website (www.thecarahotel.com), Online Travel Agencies (OTAs), walk-in, or by directly contacting The Cara Hotel official reservation number.
1.2 Room Assignment
- The Cara Hotel will attempt to accommodate all guests of the same reservation in the same room or on the same floor, subject to availability.
1.3 Required Information
- All guests must provide identification information including, but not limited to, their name, address, contact number, and email address to complete a reservation.
1.4 Reservation Confirmation
- A reservation is only considered complete when a confirmation reference number is issued by The Cara Hotel or our third-party partners.
1.5 Modifications
- Requests to modify dates, duration of stay, or to add products and/or services are not guaranteed and are subject to availability with amendment fees.
1.6 Pricing
- Room rates are adjusted based on current demand.
- Prices for the stay do not include breakfast unless otherwise specified.
2.1 Payment Terms
- All payments and refunds are subject to the cancellation and refund policy applicable to each individual booking.
- All reservation fees must be paid upon arrival before check-in if paying in person.
2.2 Security Deposit
- The Cara Hotel is authorized to collect a security deposit of RM200.00 per booking by cash or credit card pre-authorization.
- Security deposits are refunded within 5-7 business days following checkout, subject to room inspection confirming no damages and no outstanding charges.
2.3 Payment Requirements
- A valid Debit or Credit Card is required to complete any reservation with The Cara Hotel.
2.4 Accepted Payment Methods
- Credit and Debit cards (Visa and Mastercard) through on-site merchant or OTAs
- Bank Online Transfer
- Cash when paying at the property
2.5 Hotel Rights
- The Cara Hotel reserves the right to change prices without prior notice.
- The Cara Hotel reserves the right to pre-authorize credit cards without any written or verbal approval from guests.
Tourism Tax
In accordance with the Tourism Tax Act 2017, The Cara Hotel is required to collect tourism tax from foreign guests.
- Rate: RM10.00 per room per night (flat rate regardless of room type)
- Applicable to: All foreign nationals (non-Malaysian citizens)
- Exemptions: Malaysian citizens (upon presentation of MyKad or valid Malaysian identification) and Malaysian permanent residents (upon presentation of valid documentation)
- Payment: Tourism tax is payable upon check-in in addition to room rates and is remitted to the Malaysian government as required by law.
3.1 Standard Times
- Check-In Time: 3:00 PM
- Check-Out Time: 11:00 AM
3.2 Early Check-In
- Complimentary early check-in is subject to the hotel’s discretion and prior arrangement is required 1 week prior to the actual arrival date.
- The hotel reserves the right to charge for early check-in at prevailing rates:
- 10:00 AM – 3:00 PM: 50% of the nightly room rate
- Prior to 10:00 AM: 100% of the nightly room rate
3.3 Late Check-Out
- Complimentary late check-out is subject to the hotel’s discretion and prior arrangement is required 1 week prior to the actual arrival date.
- The hotel reserves the right to charge for late check-out at prevailing rates:
- 11:00 AM – 2:00 PM: 50% of the nightly room rate
- From 2:00 PM onwards: 100% of the nightly room rate
4.1 Identification
- All guests are required to present a valid photo identification (Identity Card or Passport) during check-in.
- Failure to do so may result in removal from the property or cancellation of the reservation.
4.2 Guest Conduct
- All guests must conduct themselves in a civilized manner and under no circumstances display aggressive behaviors towards other guests or staff members.
4.3 Liability for Damages
- Guests are liable for damages caused by their negligence and are subject to reparation costs or any fees deemed reasonable by The Cara Hotel.
- This may result in termination of the reservation, removal from the property, and forfeiture of the security deposit.
4.4 Access Card
- Loss or damage to room access cards will incur a replacement fee of RM50.00.
4.5 No Smoking Policy
- Smoking is not permitted anywhere on our property.
- Any person who fails to comply will be fined RM1,000.00.
4.6 No Pets Policy
- No animals are allowed on the premises.
4.7 Prohibited Items
- Guests are prohibited from bringing durian, mangosteen, and other exotic fruits that emit strong odors into the hotel premises.
- Violation of this policy may result in additional cleaning charges.
4.8 Age Requirements
- Reservations made by any person below the age of 18 will not be accepted.
- Guests below the age of 18 will only be permitted to stay when permission is given by parents verbally or non-verbally during check-in.
- Guests who fail to adhere to this rule will face automatic cancellation of their reservation without
refund.
5.1 Data Collection
- The Cara Hotel’s use of guest data follows the Malaysian Personal Data Protection Act 2010 (PDPA).
5.2 Consent
- All guests staying with The Cara Hotel automatically consent to the collection of personal data including name, surname, email address, identity number, address, contact information, and bank account details.
5.3 Purpose
- Collected data is used for research and brand development to improve our services.
- The Cara Hotel reserves the right to share collected data with its partners for promotional campaigns.
5.4 Disclosure
- Personal information will be disclosed to Malaysian authorities when required by law or official order.
- Guests with any disability who require special care should inform The Cara Hotel prior to arrival.
7.1 General Limitations
The Cara Hotel will not be liable for any loss or damage suffered by guests during their stay, including but not limited to:
- Loss of income, business, profits, opportunity, anticipated savings, data, or enjoyment
7.2 Guest Cancellations
The Cara Hotel will not be liable for cancelled reservations made by guests due to personal issues suffered before their stay, including but not limited to:
- Flight cancellations, democracy activities, or any other circumstances that may affect their reservation and stay
7.3 Force Majeure
The Cara Hotel will not be liable for cancelled reservations or failure to fulfill services due to reasons beyond our reasonable control, including:
- Acts of God, government intervention, explosion, fire, flood, riot, war, civil disturbance, revolution, or embargoes
7.4 Personal Safety
The Cara Hotel will not be liable for:
- Death or personal injuries sustained by guests on the premises
- Any unforeseeable losses (personal losses or trade losses)
8.1 Free Cancellation
- Reservations can be cancelled without charge if notice is given at least 3 days prior to 3:00 PM (local time) on the arrival date.
- Online refunds will take 7-14 working days to complete.
8.2 Late Cancellation
- Cancellation notice of less than 3 days or a no-show on the arrival date without prior information will incur a charge equivalent to the full stay amount.
8.3 Hotel Cancellations
- Reservations can be cancelled or modified by The Cara Hotel without prior notice if due to circumstances beyond our control.
- Affected guests will receive a full refund of any paid fees.
8.4 Incorrect Payment Details
- If payment details provided by guests are incorrect, The Cara Hotel reserves the right to cancel the reservation.
9.1 Amendments
- The Cara Hotel reserves the right to amend these Terms & Conditions at any time without prior notice.
9.2 Severability
- If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
9.3 Governing Law
- These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.
9.4 Agreement
- By making a reservation with The Cara Hotel, guests acknowledge that they have read, understood, and agree to be bound by these Terms & Conditions.
